Resolving Jurisdictional Disputes Without Disrupting the Job: Using the Plan Effectively
Jurisdictional disputes can stall projects, strain labor-management relationships, and create unnecessary risk for everyone involved. The Plan for the Settlement of Jurisdictional Disputes is designed to provide a fair, efficient process for resolving these conflicts—but misunderstandings about how and when to use the Plan can lead to avoidable delays and disputes.
This session offers a practical overview of how the Plan works and how both contractors and union representatives can use it effectively to address jurisdictional issues before they escalate. Participants will gain insight into the procedural steps, available remedies, and potential damages under the Plan, as well as the responsibilities and expectations placed on all parties.
The presentation will also compare the Plan to an NLRB Section 10(k) proceeding, highlighting key differences in purpose, process, timing, and outcomes. By understanding the advantages and limitations of each approach, attendees will be better equipped to select the path that promotes resolution, preserves working relationships, and keeps projects moving.
Designed for contractors, and union officials, this session focuses on practical strategies for resolving disputes efficiently—so work can continue and conflicts can be settled without unnecessary disruption.

I use my background in the unionized construction industry to guide you with a practical approach to resolving contractors' HR, labor, and benefit challenges. My approach is to tackle struggles head-on, and I do not give up when solutions are not at once clear.
I launched Just Call Joye to provide customized training, labor, and HR advice directly to employers, with the dual mission of solving problems and avoiding future ones by redesigning my clients’ best practices.
My 16 years in servant leadership at SMACNA included roles as Executive Director of Operations (COO) and Director of Labor Services and HR.
At SMACNA. I regularly advised chapters and contractors on collective bargaining, withdrawal liability, and other federal employment laws, rules, and regulations. I oversaw the internal operations of SMACNA, including membership, building operations, IT, and human resources. I coordinated the Belonging and Excellence for All (BE4ALL) initiative, which is a joint effort between SMACNA, SMART, and ITI to transform the unionized sheet metal industry into one that welcomes and retains all workers who have the interest and skills to thrive in the industry.
I developed and taught trust fund education to chapters, contractors, and trustees. I am also a certified employee benefit specialist (CEBS) trained in many aspects of administering employee benefits.
